1. About BuyMedia.ng
BuyMedia.ng (“the Platform”, “we”, “us”, or “our”) is an online marketplace operated by Buymedia Digital Limited, a company incorporated in Nigeria under the Companies and Allied Matters Act (CAMA) 2020. Our registered address is Plot 12, Bode Thomas Street, Surulere, Lagos State, Nigeria.
The Platform enables buyers to browse, select, and purchase advertising media placements directly from verified media partners (“Partners”), including television stations, radio stations, newspapers, and outdoor media operators across Nigeria.
BuyMedia.ng is registered with the Advertising Regulatory Council of Nigeria (ARCON) and operates within the framework of Nigeria's advertising standards and regulations.
2. Eligibility & Account Registration
To use the Platform and make bookings, you must:
- Be at least 18 years of age
- Be a legal entity or individual with the capacity to enter into binding contracts under Nigerian law
- Provide accurate, current, and complete registration information
- Maintain the security and confidentiality of your account credentials
You are responsible for all activities that occur under your account. Notify us immediately at hello@buymedia.ng if you suspect unauthorised use of your account.
3. Booking & Payment
Booking confirmation: A booking is confirmed when you complete payment. An email containing your booking reference will be sent to your registered email address immediately.
Payment processing: All payments are processed securely through Paystack and/or Stripe. By making a payment, you authorise us to charge the stated amount to your selected payment method. All amounts are in Nigerian Naira (₦).
Availability: Media placements are subject to availability. In the unlikely event a confirmed slot becomes unavailable, we will notify you and offer a full refund or equivalent alternative.
4. Creative Materials & ARCON Compliance
You are solely responsible for all advertising materials (“Creatives”) submitted through the Platform. By submitting a Creative, you warrant that:
- You own or hold all necessary rights and licences to use the Creative and its content
- The Creative complies with all applicable Nigerian laws and ARCON guidelines
- The Creative does not contain false, misleading, defamatory, offensive, or unlawful content
- The Creative meets the technical specifications stated for the relevant placement
We reserve the right to reject any Creative that violates ARCON guidelines, applicable law, or these Terms.
5. Platform Rules & Prohibited Use
You agree not to use the Platform to:
- Advertise products or services that are illegal under Nigerian law
- Submit false, fraudulent, or misleading booking information
- Circumvent our payment system or book placements through unofficial channels
- Use automated tools, scrapers, or bots to access or extract Platform data
- Interfere with or disrupt Platform infrastructure or other users
- Resell Platform access or bookings to third parties without prior written consent
6. Platform's Role & Liability
BuyMedia.ng operates as an intermediary marketplace. We are not the publisher, broadcaster, or operator of any media placement listed on the Platform.
To the fullest extent permitted by Nigerian law, BuyMedia.ng shall not be liable for indirect, incidental, or consequential damages, loss of profits, Partner actions outside our control, or force majeure events. Our total liability shall not exceed the amount paid for the specific booking giving rise to a claim.
7. Intellectual Property
All Platform content — including the BuyMedia.ng name, logo, design, software, text, and graphics — is owned by or licenced to Buymedia Digital Limited. You may not reproduce or create derivative works without our express written permission.
You retain ownership of your Creatives. By submitting a Creative, you grant BuyMedia.ng a limited, non-exclusive licence to use it solely for delivering the booked placement and for internal records.
8. Privacy & Data
Your use of the Platform is governed by our Privacy Policy, incorporated into these Terms by reference. We process personal data in accordance with Nigeria's Data Protection Act 2023 (NDPA) and the Nigeria Data Protection Regulation (NDPR).
9. Cancellations & Refunds
Cancellations and refunds are governed by our separate Cancellation & Refund Policy, which forms part of these Terms. Please review that policy before making a booking.
10. Changes to These Terms
We may update these Terms to reflect changes in our services, applicable law, or business practices. We will notify registered users of material changes by email or platform notice. Continued use after the effective date constitutes acceptance of the revised Terms.
11. Governing Law & Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Lagos, Nigeria, under the rules of the Lagos Court of Arbitration.
